In Santos Limited v Helix Energy Services Pty Ltd [2009] VSC 282 (10 July 2009), Byrne J decided a forum dispute between Santos and Helix Energy after proceedings concerning the same subject matter were commenced in both the Supreme Courts of South Australia and Victoria. Apart from contractual provision, little if anything tied the parties to either jurisdiction. Nothing in terms of substance of dispute suggested SASC more appropriate forum in interests of justice. Helix Energy's application to transfer the Victorian proceedings to the Supreme Court of South Australia was dismissed.
