In Tony Brown t/a T & DK Building Maintenance v Tsiotsios [2009] CCT BD240-08 (12 February 2009), the Queensland Commercial and Consumer Tribunal (CCT) dealt with an application by the applicant builder for payment of the balance of monies owing for building works completed at the home of the respondent. The CCT found, amongst other things, that there was a written contract between the parties that was enforceable pursuant to section 92 of the Domestic Building Contracts Act 2000. The contract included unsigned variations. The CCT ordered the respondent to pay the applicant the balance of monies owing on the contract, less the reasonable costs of rectification.
