In 1144 Nepean Highway Pty Ltd v Leigh Mardon Australasia Pty Ltd [2009] VSC 226 (11 June 2009), the Supreme Court of Victoria recognised the legitimacy of expert determinations as a means of resolving disputes and that parties will be bound by their agreement where they have incorporated a dispute resolution clause in their contract.
