In Hine v New South Wales Land and Housing Corporation [2009] FCA 1242 (4 November 2009), the Federal Court made a determination on liability arising from a head contract and a sub contract. The Court (in dismissing the applicants' application) held that the principal's representative's direction was not misleading or deceptive because it accurately represented the position of the principal and the principal's representatives at the relevant time. Elements of tort of inducing breach of contract were also not established.
